1. Who these terms are with

These terms are between you and Peña Media Group (“we”), Los Angeles, California, info@penamediagroup.com. By using this website or hiring us, you agree to them. If you do not agree, please do not use the site or our services.

2. The website

The site is provided for information about our work. It is provided “as is”. You agree not to misuse it: no attempts to break or overload it, scrape it in bulk, send spam through the contact form or use it for anything unlawful.

3. Services

We provide consulting, marketing, creative, content and related media services. The specific work, deliverables, schedule and fee for each project are set out in a written proposal, statement of work, invoice or email that you accept. If something is not in writing, it is not part of the work.

We may use subcontractors and software tools, including AI-assisted tools, to deliver the work. We remain responsible for what we deliver to you.

4. Fees and payment

  • Fees are as stated in the proposal or invoice. Unless it says otherwise, invoices are due within 14 days of being issued.
  • Card payments are processed by Stripe. By paying, you also agree to Stripe’s terms.
  • If a payment is late, we may pause work until the account is current. Fees are in US dollars and exclude any taxes that apply to you.

5. What you give us

You are responsible for the materials you supply (text, images, logos, data, access) and confirm that you have the right to use them and to let us use them for the project. You are responsible for the claims you ask us to make about your products or services being true.

6. Ownership

Once you have paid in full, you own the final deliverables we create specifically for you, to the extent we can legally transfer them. Our own tools, software, templates, methods and any materials we had before the project, or develop independently of it, stay ours; you may use them as part of the deliverables.

Unless we agree otherwise in writing, we may describe the project and show non-confidential finished work in our portfolio.

7. Confidentiality

Each of us will keep the other’s non-public business information confidential, use it only for the project, and not disclose it except to people who need it to carry out the project or where the law requires. This does not apply to information that is already public or that you ask us to publish.

8. Results are not guaranteed

Marketing, advertising and media outcomes depend on many things we do not control, including platforms, audiences, budgets and timing. We will do the work carefully, but we do not guarantee any particular number of views, leads, sales or rankings.

9. Refunds and cancellation

You may cancel a project in writing at any time. You will pay for work completed and costs incurred up to the cancellation. If you have prepaid for work we have not started, we will refund it. Other refund requests made within 14 days of payment are reviewed case by case; after that, fees for completed work are not refundable unless the law says otherwise.

10. Disclaimer

Except as stated in these terms, the website and services are provided without warranties of any kind, to the fullest extent the law allows, including any implied warranty of fitness for a particular purpose.

11. Limit of liability

To the fullest extent the law allows, we are not liable for indirect, incidental, special, consequential or punitive damages, or for lost profits, revenue or data. Our total liability for any claim connected with our services is limited to the amount you paid us for the work the claim relates to in the 12 months before the claim arose.

12. Your responsibility to us

You agree to cover losses and costs we suffer from a third-party claim that materials you supplied, or claims you directed us to make, infringe someone’s rights or are unlawful.

13. Governing law

These terms are governed by the laws of the State of California, without regard to its conflict-of-law rules. Any dispute will be brought in the state or federal courts located in Los Angeles County, California, and you and we consent to those courts.

14. Changes and contact

We may update these terms; the version posted here, with its date, applies from then on and does not change work already agreed in writing. Questions: info@penamediagroup.com. See also our Privacy Policy.
